Managed solely by ASMFC - no federal fishery management council role was found in the sources reviewed - under a regional framework with four stock units (Massachusetts-Rhode Island, Long Island Sound, New Jersey-New York Bight, and Delaware-Maryland-Virginia), each carrying its own size, season and bag rules that are not uniform coastwide and that can vary by month within a single region (recreational minimum size runs about 15-16 in, but bag limits and open seasons differ region by region and state by state). The 2025 benchmark assessment found the Massachusetts-Rhode Island and Long Island Sound stocks not overfished and not subject to overfishing, the New Jersey-New York Bight stock subject to overfishing, and the Delaware-Maryland-Virginia stock both overfished and subject to overfishing - status is materially worse toward the southern part of the range. Illegal harvest for the live-fish market has been a persistent, documented enforcement problem: ASMFC's own FMP review cites a coastwide commercial harvest-tag return of only 31% in 2022, with roughly 13,000 issued tags unaccounted for, and a 2017 amendment created the tagging program specifically to address undocumented harvest.
